Terms & Conditions
1. Introduction
Norfolk Property Photos is a trading name of Image Quest Photography. These Terms and Conditions apply to all photography services provided by Norfolk Property Photos/Image Quest Photography (“we”, “us”, “our”). By booking a service, the client (“you”, “your”) agrees to be bound by these Terms and Conditions.
2. Bookings & Cancellations
– All bookings must be confirmed in writing (email or text message accepted).
– If you cancel a confirmed shoot less than two working days before the scheduled time, a cancellation fee equal to the full shoot price will be charged.
- If we reschedule a shoot due to poor weather, no cancellation fee will be charged, and we will reschedule the shoot as soon as possible—typically within a week.
- If we have assessed the weather forecast and deem it to be unsuitable for photography we have the right to reschedule and make no compensation payment to do so.
- If you decide you still want us to go ahead with the photography on a day of unsuitable weather you accept that the image quality will be impaired.
3. Payment Terms
– Full payment is due prior to image delivery.
– Payment details will be included on the invoice.
– Images will not be released until payment has been received in full.
– Late payments may result in delays in delivery and could incur additional fees.
4. Copyright & Usage Licence
– Norfolk Property Photos retains full copyright of all images produced.
– Upon receipt of payment, you will be granted a non-transferable licence to use the images solely for the purpose agreed at the time of booking (e.g., property marketing).
– You may not resell or reuse the images for any other purposes without prior written permission.
– We reserve the right to use any images we create for our own marketing and promotional purposes, including our website, social media, and printed materials.
– We may also resell images to third parties with a legitimate interest in the property (e.g., if a vendor changes estate agents, we may license the images to the new agent or the vendor directly).
5. Image Delivery
– We aim to deliver final edited images within two working days of the shoot (subject to payment of service) unless otherwise agreed or in the case of unforeseen circumstances (e.g., illness).
– Images will be delivered digitally via WeTransfer, Smash, or similar services.
– If you require delivery on a USB memory stick, this can be arranged for an additional charge of £60.
6. Client Responsibilities
– You are responsible for ensuring the property is clean, tidy, and ready at the time of the shoot.
– All areas to be photographed must be accessible, and pets or people should be kept out of frame unless agreed in advance.
– Parking and access should be arranged in advance if restrictions apply.
7. Image Alterations & Retouching
– Standard editing (e.g., brightness, colour balance, sky replacement) is included.
– Additional retouching requests may incur extra charges and must be discussed in advance.
8. Limitations of Liability
– We take great care to deliver high-quality work, but we are not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the images.
– Our liability is limited to the amount paid for the specific shoot in question.
– We are not liable for delays caused by events outside our control (e.g., weather, illness, technical failure).
9. Changes to Terms
We reserve the right to amend these Terms and Conditions at any time. The current version will always be available on our website.
10. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
